Birthday Celebration Sweepstakes
Official Rules & Regulations
1)
Eligibility: The Tire Warehouse Tires &
Auto Parts for Less Sweepstakes (the "Sweepstakes") is open to legal individual
residents of CT, MA, ME, NH, NY, RI and VT who are 18 years of age or older at
time of entry. Employees, officers, directors (and their immediate families and
those living in their same household) of Tire Warehouse Central Inc.
("Sponsor"), and their respective parent companies, subsidiaries, licensees,
affiliates, retailers, distributors, suppliers, advertising, promotion and
production agencies are not eligible to participate or win. Void where
prohibited. The sweepstakes is subject to all applicable federal, state and
local laws and regulations.
2)
How
to Enter: No Purchase Necessary. The
Sweepstakes begins at 8:00 a.m. Eastern Time (ET) on June 18, 2007 and ends at
6:00 pm ET on November 30, 2007 (the "Promotion Period".) To enter Sweepstakes
go to your local Tire Warehouse Tires & Auto Parts for Less location (Where it
is prohibited by law entrant may print the entry form and mail it to the
Administrators address: Tire Warehouse Central, Inc. 492 Main St., Keene, NH
03431.) during regular business hours, submit a fully completed official entry
form. Forms are available at the store or online at
www.tirewarehouse.net/10000BirthdayCelebration. Limit of one entry per
person per day during the promotion period. The Sponsor and any Internet access
providers, their respective parents, affiliates, divisions, and agencies and
each of the foregoing entities' respective employees, officers, directors,
shareholders, and agents (the "Released Parties") are not responsible for, human
error, technical malfunctions, inability to access web sites, damage to a user's
computer system (hardware and software) due to participation in this Sweepstakes
or any other problem or error that may occur, or for late, lost, incomplete,
stolen, misdirected, mechanically reproduced, illegible, or incorrectly entered
entries. Participants who submit inaccurate data and/or exceed the entry limits
may be excluded from participation at any time during the promotion. All entries
become the property of the Sponsor. Any entry information collected from the
sweepstakes shall be used only in a manner consistent with the consent given by
entrants at the time of entry, with these Official Rules, and with Sponsor's
Online Privacy Policy which can be found at www.tirewarehouse.net. Entrants
agree to be bound by these rules and consent to use of their names and/or
photographs for advertising or publicity purposes by Sponsor and its designees
in any and all media without further consideration, except where prohibited by
law.
3)
Prize
Drawing: On or about December 7, 2007 a
random drawing of approximately forty-eight (48) eligible finalists will be
selected from among all eligible entries received. Each of the finalists is
subject to eligibility verification and compliance with these official rules.
Tire Warehouse Central, Inc. will notify each finalist by certified mail within
seven (7) days of the prize drawing. Potential winners will be required to sign,
have notarized and return to Tire Warehouse Central, Inc. an affidavit of
eligibility/release of liability, and, where legal, a publicity release within
fourteen (14) days of issuance of notification. Failure to complete and return
the documents in the time noted or if prize notification is undeliverable will
result in disqualification from the final Grand Prize drawing. Once potential
winners are verified for eligibility they must be present, in order to
participate, at a special media event for the final $10,000 Grand Prize drawing
to select the Grand Prize winner. (A specific location to be determined by
Sponsor at the time of initial notification to all eligible finalists.)
Remaining eligible finalists will receive a consolation prize of one (1) $100
Tire Warehouse Gift Card (No cash substitutions permitted.) Drawing will be
conducted by Tire Warehouse Central, Inc. whose decisions are final and binding
on all matters relating to this Sweepstakes. All prize winners must be 18 years
of age or older. Acceptance of the prize constitutes permission for the Sponsor
and its designees to use winner's name and likenesses for advertising and
promotional purposes without additional compensation unless prohibited by law.
Odds of winning prize are subject to the total number of eligible entries
received.
4)
Prize: One (1) Grand Prize will be
awarded: $10,000.00 dollars in US currency. Up to forty-seven (47) $100.00 Tire
Warehouse Gift cards will be awarded as consolation prizes. All taxes and
expenses relating to the acceptance of the Grand Prize and Consolation Prize are
the responsibility of the winners. All details of prize not specified herein
shall be determined solely by Sponsor. No prize substitutions or transfer of
prize permitted except at the sole discretion of the Sponsor.
5)
Limitations of Liability: Each participant
agrees (i) to abide by the terms of these Official Rules and the decisions of
the Sponsor which are final and binding on all matters relating to this
Sweepstakes, and (ii) to release, discharge, indemnify and hold harmless the
Released Parties from any & all claims, actions, and/or liability for any
injuries, loss or damage of any kind arising from or in connection with
participation in and/or for entry into this Sweepstakes, any related activities,
or acceptance or use of any prize won.
6)
General Conditions: If for any reason this
Sweepstakes is not capable of running as planned due to infection by computer
virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or
any other causes beyond the control of the Sponsor which corrupt or affect the
administration, security, fairness, integrity or proper conduct of this
Sweepstakes, the Sponsor reserves the right at its sole discretion, to
disqualify any individual who tampers with the entry process, and to cancel,
terminate, modify or suspend the Sweepstakes. Should this Sweepstakes be
terminated, Sponsor reserves the right to select potential winner in a random
drawing from among all eligible, non-suspect entries received as of the action
requiring such termination. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR
UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF
CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES
THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE
FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Winner’s Names: For names of winners,
available after January 3, 2008, go to
www.tirewarehouse.net/10000BirthdayCelebration or send a stamped,
self-addressed envelope to Tire Warehouse Central, Inc. 492 Main Street, Keene,
NH 03431 – Attn: Birthday Celebration. Requests received after February 15, 2008
will not be honored.
